GEORGE TOWN: The State Commission of Inquiry (SCI) tasked with investigating the Tanjung Bungah landslide in October 2017 has found the design engineer of the slope primarily responsible for the incident that claimed 11 lives.

The SCI, in its 116-page report made public, has recommended that the engineer be investigated by the police under Section 304A of the Penal Code for gross negligence.

Besides the engineer, the commission found another design engineer responsible for being “contributorily negligent” for allowing excavation to be carried out without design, engineering calculations and supervision.

Chief Minister Chow Kon Yeow said the commission found that the slope failure was a man-made tragedy and entirely preventable if those in charge had taken necessary and proper steps to ensure the stability of the slope and the safety of the workers.

“The landslide did not develop overnight, it was a disaster waiting to happen over a period of time.

“There were ample warnings which were sadly unheeded or inadequately heeded,” Chow said of the report at a press conference at his office in Komtar here yesterday.

Chow said the report, dated July 22 this year, was a result of public hearings conducted over 26 days with testimonies from 28 witnesses.

“The commission also considered voluminous documents, reports, photographs and drawings, as well as the opinions of six expert witnesses.

“The report provides further analysis of the background facts, excerpts of testimonies recorded during the hearings and findings on liability against several parties,” he said.

The commission also found the Occupational Safety and Health Department negligent for failing to take adequate steps to ascertain the extent of the danger posed by the unsafe slope, by not promptly issuing a prohibition notice after its visit to the site on Aug 18, 2017, which was two months before the fatal incident.

Chow said copies of the report would be sent to the police, Attorney General’s Chambers, Board of Engineers Malaysia and other authorities involved.

“The report also contains nine recommendations that the commission hopes will serve as guidelines and prevent such incidents from recurring,” he added.

On Oct 21, 2017, a temporary slope in the construction site of a high-rise apartment block in Tanjung Bungah collapsed while workers were trying to stabilise it. Tonnes of earth crumbled, killing 11 workers.

Chow: Agencies have to act against negligent engineers

 GEORGE TOWN: It is up to the relevant agencies to take action against the consultant engineers who were found negligent, resulting in the Tanjung Bungah landslide tragedy, says Chief Minister Chow Kon Yeow.

“It is up to the agencies and the police to take action as recommended by the State Commission of Inquiry (SCI).

“I have also directed the Town and Country Planning Department, Penang Island City Council, Seberang Prai Municipal Council and other related agencies to come up with recommendations to improve hill development.

“It was discussed at the State Planning Committee meeting and I have directed state housing, town and country planning and local government committee chairman Jagdeep Singh Deo to head the committee and come up with the recommendations within a month, ” said Chow at Komtar here yesterday.

It was reported that the SCI tasked with investigating the Tanjung Bungah landslide in October 2017 had found the design engineer of the slope primarily responsible for the incident that claimed 11 lives.

Penang Island City Council engineering director A. Rajendran, who was also present at the press conference, said the stop-work order on the project was lifted after the developer completed mitigation works.“However, different engineers have been overseeing the project since work resumed some time ago, ” said Rajendran.

Special task force formed to probe landslide


GEORGE TOWN: The state government has formed a special investigative committee to probe the landslide at the Bukit Kukus Paired Road construction site in Paya Terubong.

Chief Minister Chow Kon Yeow said preliminary reports by the Penang Island City Council (MBPP) and the Drainage and Irrigation Department showed there were elements of non-compliance in construction procedures carried out at the site.

He said the committee would be led by Deputy Chief Minister I Datuk Ahmad Zakiyuddin Abdul Rahman, with State Public Works, Utilities and Flood Mitigation Committee chairman Zairil Khir Johari as a member and an engineer from the state secretary’s office.

“Relevant agencies, contractors, sub-contractors and independent checking engineers involved in the project will be questioned,” he said during a press conference in his office at Komtar yesterday.

Chow said this was a separate investigation from the compulsory investigations carried out by the Department of Occupational Safety and Health and Construction Industry Development Board among other relevant agencies.

Once investigations are complete, Chow said the findings would be brought to the Board of Engineers Malaysia, an agency under the Works Ministry that monitors and regulates engineers.

“MBPP is not involved in the investigation as it is the project owner,” said Chow.

Action taken over irregularities at paired road project, says Zairil


A special task force detected several irregularities when conducting spot checks at the Bukit Kukus Paired Road project site earlier this month.

State Works, Utilities and Flood Mitigation Committee chairman Zairil Khir Johari said the task force, formed under the Erosion and Sedimentation Control Committee (Ops Lumpur), was to check for compliance under the Erosion and Sedimentation Control Plan (ESCP).

“On Oct 8, a team led by the Drainage and Irrigation Department found sediments in a pond and irregularities in the check dams.

“The stockpiles were not maintained well and could affect the flow of Sungai Relau during heavy rain, causing mud floods, he told reporters in Komtar yesterday.

Zairil said as per the standard operating procedure, the Ops Lumpur team issued a letter to the consultant of the project, demanding that mitigation measures be taken within 14 days.

“On Oct 12, the findings of Ops Lumpur were reported to the Erosion and Sedimentation Control Committee and the next day, an initial stop-work order was issued by the Department of Occupational Safety and Health (DOSH) following the beam collapse.

“A full stop-work order was issued by DOSH on Oct 17,” he said.

Zairil said on Sept 28, his office received a report on the concerns over hill-clearing activities in Penang from the Penang Hills Watch, and replied to them on Oct 4.

“I was concerned about the complaints, as erosion and sedimentation would indeed cause bottlenecks in the rivers downstream, especially during the rainy season.

“Claims that the complaints were not attended to are untrue. In fact, action was taken immediately,” he said adding, “The cause of the Bukit Kukus landslide must be uncovered.”

Impossible to ignore : The large concrete pillars that remain standing at the Bukit Kukus landslide site in Paya Terubong.

GEORGE TOWN: A row of giant concrete pillars soaring high into the sky serves as a reminder of the landslide tragedy which claimed nine lives at the Bukit Kukus Paired Road project in Paya Terubong.

The tallest of them stands at about 20 storeys and remains perched between the hills where soil erosion brought down 13 containers housing the ill-fated foreign workers last Friday.

Before the Department of Occupational Safety and Health Department (DOSH) gives the all clear for the project to resume, most of the workers at the site have remained while a few moved out to look for temporary work.

A Bangladeshi worker who declined to be named was seen carrying a cardboard box containing his personal belongings to another construction site nearby.

“The boss said there is no more work here, so I contacted my friend who recommended me for another job. I will be staying at his place.

“Once this project resumes, I shall come back,” the 30-year-old said.

At the site, rubble was scattered all over the 9,290 sq m site with the 13 green containers salvaged by cranes left in a corner.

The last foreign worker to be found was 33-year-old Bangladeshi Mohamad Uzzaal. He was pinned under a container and rescuers had to dig 10m to extricate the body.

At the height of the ops, two cadaver dogs were despatched to the scene to search for bodies while two other sniffer dogs were there to locate survivors.

A small open area beside a farm further up the hill above the site where photographers and videographers camped for five days to capture the ongoing rescue operation remains cordoned off.

On Monday, the media was taken on a tour of the site after the search and rescue operation, involving over 100 rescue personnel, was called off.

The water in the stream, which looked like teh tarik on Friday, was crystal clear now after its flow on top of the hill was diverted.

Even as the ops ended and all the missing foreign workers had been located, residents living nearby raised their concerns over the project.

Technician Tan Keng Wee, 36, hoped that the project would continue since most of it had already been done, but wanted better safety measures in place at the site.

“The traffic in Paya Terubong during peak hours is chaotic due to the narrow road passing by the hills. We need the new elevated road bypass but please make sure it is safe,” he said.

Food stall operator Mohd Subri Noor, 52, also shared his concern.

“I’m worried as many landslides have happened here. Many of them could have been prevented,” he said.

Engineer vs Doctor


Engineers are supposed to be born intelligent. If they didn’t get a job they have a lot of tactics by which they can earn money. This humorous story tells us how an Engineer tries to make money from a doctor by taking him on a ride.

Both engineers and doctors are qualified enough to serve the humanity in the best possible way. You might have read many funny stories about fights and quarrel between engineers and doctors, but the one I have come up with today will surely make your day.

Engineer opt doctor’s Profession



This story begins with one of the major problems of the society, which is unemployment. So, one unemployed engineer tried to opt the doctor’s profession because he thinks to be a doctor, he can make money easily

So he opened a medical clinic, puts a sign on the clinic saying that he will charge $500 for the ailment and will pay back $1000 if he fails.

One day, when an unemployed doctor read that statement, he had a thought in his mind to earn $1000 from that engineer.

First Incident



The doctor went to the engineer and told him that he had lost his sense of taste. The engineer who was super smart asked his nurse to bring medicine from box 22 and put 3 drops in doctor’s mouth.

Doctor guessed the medicine to be gasoline. The engineer congratulated the doctor saying that his sense of taste was back and charged him $500.

Second Incident


After the first incident, the doctor was very annoyed as to how anyone can make fool of him.So he gets back to the engineer with another plan. He now tells the engineer that he had lost his memory.

Again engineer played tactfully with him and told his nurse to bring medicine from box 22 and put 3 drops in doctor’s mouth. Before the nurse could do that, the doctor recalls and says that box contained gasoline.So the Engineer by his smartness told the doctor that his memory was back and charged him $500.

Third Incident



The doctor was very angry after first the two incidents and he decided that he will get his money back. So, he went again to the engineer and told him that he had lost his vision.

The Engineer smartly told him that he had no prescription for it. So he gave him $500. But the doctor impulsively said that the amount was $500, not $1000.

And, again the engineer pointed out to the doctor that, since he knows the difference between $500 and $1000 his eyesight is good. The doctor was left with no option than to accept defeat.
